Join us without commitment for two calendar weeks and see if karate is a good fit for you and your study of the martial arts. No uniform is needed -- just comfortable work-out clothing. The Undersigned agrees to take and Mizuchi Dojo LLC (HEREIN AFTER "THE SCHOOL") hereby agrees to teach a course of Karate/Self Defense lessons for a period of two weeks. The Undersigned further understands that this agreement is the entire agreement between us and that failure to attend or complete the above trial period of enrollment does not obligate THE SCHOOL to extend the trial period.

The Undersigned is otherwise not obligated to pay for the period of the trial.  The Undersigned also is not obligated during the trial period to purchase from THE SCHOOL the Safety Equipment and any other student curriculum materials that may otherwise be required and will not engage in any training activities where those student curriculum materials are required to engage in the training. 

The Undersigned understands that under the terms of this agreement THE SCHOOL obligates itself to provide competent instructors and suitable facilities for teaching the lessons. All class sessions are supervised by qualified personnel trained in the procedures and traditions of the Martial Arts.

The Undersigned hereby represents that he/she/they or the student they are engaging in the trial period in good physical health to take the karate/self-defense course of instruction. 

The Undersigned understands that students and visitors may be videotaped and photographed at THE SCHOOL. I give permission for THE SCHOOL to use any videos or photos of myself or my children for advertising, marketing, or as THE SCHOOL sees fit.

The Undersigned understands that during the course of instruction, employees of THE SCHOOL and/or other students or authorized persons will be engaged in a course of conduct requiring physical contact: and the Undersigned gives full consent to such physical contact required by training. The Undersigned further acknowledges the existence of some risk of personal injury in participating in karate/self-defense course of instruction and the Undersigned is assuming this risk without liability to THE SCHOOL, its principals, stockholders, directors, employees, agents, assigns, or successors who shall not be liable for any claims, demands, injuries, damages, or causes of action whatsoever.

The Undersigned acknowledges receiving a copy of this agreement.

CONSUMERS RIGHT TO CANCELLATION: YOU MAY CANCEL THIS CONTRACT THIS CONTRACT WITHOUT ANY PENALTY OR FURTHER OBLIGATION WITHIN (3) DAYS FROM THE DATE OF SIGNING.  Notice of cancellation shall be in writing and mailed to the school by registered or certified mail. As required by NYS General Business Law you have certain rights to cancel this agreement. These are set forth on this agreement and are made a part of this agreement.

ADDITIONAL TERMS

1. MEMBER RIGHT TO CANCEL: YOU MAY CANCEL THIS CONTRACT THIS CONTRACT WITHOUT ANY PENALTY OR FURTHER OBLIGATION WITHIN (3) DAYS FROM THE DATE OF SIGNING.  If you wish to cancel this contract you may cancel by making a written notice and mailing it by registered or certified mail to THE SCHOOL by midnight of the third business day after signing this contract. Such notice shall be accompanied by the contract forms and any other membership documents previously delivered to the applicant.

2. ADDITIONAL RIGHTS TO CANCEL: The student estate can cancel after three days if the buyer dies, without further obligation. The student may cancel if upon a doctor's order he/she/they cannot physically receive the services because of a significant physical disability. The student may cancel if he/she/they moves from the area to a location more than 25 miles from a school operated by Mizuchi Dojo LLC. You may cancel this agreement if the school closes and the services cease to be offered.

3. HOURS OF OPERATION: Daily Except Sundays. Closed Holidays. Hours to be posted.

4. SIGNING IN: All students are required to sign in before class.

5. OPTIONAL UNIFORM: Shall consist of White Gi jacket and Gi pants or Red Gi jacket and Black Gi pants. Black Gi jacket and Gi pants can only be worn by instructors. Street clothes can be worn during the trial period but thereafter can only be worn by students for class when specified on the schedule by the head instructor.

6. MEMBERSHIPS: Are not assignable or transferable without the written permission of THE SCHOOL.

7. PERSONAL PROPERTY: THE SCHOOL, its employees, or agents shall not be responsible for damaged, lost, or stolen articles of clothing or any personal property of the student or a guest.

8. AMENDING OF RULES: THE SCHOOL reserves the right to amend the rules at any time it may deem necessary for the proper management of THE SCHOOL.

9. COMPLIANCE WITH RULES: Undersigned/Student agrees to obey all school rules and THE SCHOOL reserves the right to revoke or terminate memberships if rules are not obeyed. 

10. HOLD HARMLESS: Undersigned/Student agrees to Hold Harmless and indemnify Mizuchi Dojo LLC its principals, stockholders, directors, employees, agents, successors and assigns from any and all causes of action, claims or damages resulting from the misuse, excessive force, injuries or damages caused by a student's negligent, reckless, or willful use of the karate/self-defense skills learned at THE SCHOOL.

11. TERMINATION OF MEMBERSHIP: If THE SCHOOL determines at its own discretion that the inclusion of any member represents a burden on THE SCHOOL or any other student or employee of THE SCHOOL, then THE SCHOOL, at its option, can terminate a student's membership by giving the student written notice. 

12. INVALID PROVISIONS: Should any provision(s) of the Agreement be declared invalid by any court of competent jurisdiction or unenforceable by any reason of any rule or law or public policy, all other provisions shall, nevertheless, remain in full force and effect and no provision shall be deemed dependent upon any other provision unless so specified.

13. DEFINITIONS: Whenever used herein, UNDERSIGNED shall mean buyer, student, or parent or guardian of student having legal competence to bind a contract. THE SCHOOL means Mizuchi Dojo LLC.
